  • Cultural Nationalism is good but dependent on individuals. Hindus want equality before law. Article has eight examples. Viksit Bharat can happen when discrimination is removed.

This article was now triggered by an article What Explains Arnab Goswami's Pivot?  Wherein the author wonders why Arnab (perceived to be a BJP supporter) criticised the BJP/Central government on three issues i.e. pollution NCR, Aravallis judgement and display of wealth during a leaders wedding in Madhya Pradesh.

 

The intent of this article is to express unhappiness on the failure of the BJP led Central government to remove discrimination against Hindus during its eleven years rule. It is for reasons like these that the BJP got fewer than expected seats in 2024.

 

At the outset must state that the BJP government did very well by modifying Article 370 over six years ago, has provided macro-economic stability, taken numerous steps to reinforce India’s Indic culture, established corridors in Kashi/Mahakal, introduced new laws on immigration and dealt well with a complex geo-political environment. We expect more from a BJP government. 

 

Know of eight examples of discrimination.

 

1. Over-ruling 2018 Supreme Court Order under the SC/ST Atrocities Act

“The petitioners challenged the constitutional validity of the s 18A of the Schedule Castes and Scheduled Tribes (Prevention of Atrocities) Act,1989 (the Act), introduced by the 2018 Amendment to the Act. The section allows for ‘automatic arrest’ which is an arrest without an FIR or prior approval.” Supreme Court Observer.

 

According to a search “Supreme Court's March 2018 ruling: In the case of Subhash Kashinath Mahajan v. State of Maharashtra, a two-judge bench of the Supreme Court, citing the rampant misuse of the Act, introduced safeguards against arbitrary arrests.”  “In essence, the SC emphasizes FIRs must be genuine, but doesn't allow detailed evidence review at the FIR stage, focusing on what's apparent from the face of the complaint to prevent misuse while ensuring justice for victims, according to LawBeat.” 2025 SC order says prove caste-based intent.

 

It is the BJP that introduced Sec 18A means automatic arrest without FIR. “Preliminary enquiry shall not be required for registration of a First Information Report against any person. The investigating officer shall not require approval for the arrest, if necessary, of any person.” Official Gazette 17/8/2018

 

2. In 11 years, why has the BJP government not declared Hindus a minority in UT of Jammu and Kashmir, Nagaland, Punjab, Mizoram, Meghalaya?

a. May be if the BJP had done so, 42 out of the 50 seats at the Shri Mata Vaishno Devi Shrine Board run Medical College might not have gone to Muslims

 

The Centre or the LG’s office did not deem it fit to explain under what rules did 42 Muslims get those seats and what was the contribution of the State government to establishing and running the Shrine Board Medical College.

b. The Narasimha Rao led Congress government declared Sikhs and Buddhists a minority around 1992/93. A 2007 judgement of the Punjab and Haryana High Court held Sikhs not be a minority when by population they are in majority and been ruling the state since inception. The matter is in the Supreme Court since 2016, according to this report. Thus, educational institutions in Punjab run by the SGPC (Shiromani Gurdwara Prabhandhak Committee) continue to avail benefits under Article 30     Source earlier article

Why could the BJP not push the honorable SC to give its judgement on matter?  

 

3. The BJP has given up the debate on the colonial/congress definition of minority

J Sai Deepak wrote in India that is Bharat, “Religious minorities in this context were denominational minorities from within the same religion, namely Christianity.” Pg. 93 Read  Who is a Minority

 

A community with a population exceeding 20 crores is considered a minority!

 

4. The Right to Education Act was not made applicable to Minority run schools i.e. Christians, Muslims etc, in 11 years.

Minority institutions are exempt from reserving 25% of the seats under the Right to Education (RTE) Act. Conversely, Hindu schools have to reserve 25% of their seats for allocation by the government. Read  Equality before Law is a myth

 

If the BJP could over rule the SC w.r.t SC/ST Atrocities Act what is preventing it from doing away with the 25% reservation for Hindu schools under RTE?

 

5. Reservations in Private Universities.

Parliamentary Panel backs such reservations Taking cue, Maharashtra Enforces Reservation Quotas in Private Universities Under State Law Given the precarious financial position of the Maharashtra state government, funding is a concern. It is a matter of time before other states follow suit.

 

The number of seats for general category is falling. BJP must realize if the discrimination continues, more will migrate never to return.

6. Scholarship Focus is Minorities

The Government of India provides Scholarships to Minorities (primarily Muslims). Academic Year 2021-22 Pre-Matric Rs 1,329 crores.(1129 cr), Post-Matric Rs 469 crores.( 501 cr) and Professional Courses Rs 353 crores (381 cr). Figures in brackets are for year 2014-15. Total scholarship in year 2021-22 Rs 2,151 crores and 2014-15 Rs 2,011 crs.

7. Similarly, the BJP seems to have given up the intellectual battle on Caste

The BJP has accepted the British/Congress/Leftists narrative. While accepting it is a tough battle, the BJP has not, based on Dharampalji monumental work, made a case to the Supreme Court to review its understanding of caste. Except author Gurcharan Das and IIM B retired Professor Vaidyanathan, few have written about the Benefits of Caste System

 

8. Today, Scheduled Tribes remain ST even after converting to Islam and Christianity.

This encourages conversions and social unrest. Why has the BJP not changed the law on this?

 

So every time the Hindu gets restive, cultural nationalism is evoked.

This could take various forms like presenting a copy of the Holy Gita to Russian President Putin or singing of Vande Mataram. Whilst appreciating such moves, any keen observer can decipher the underlying timing and motive.

 

In this BJP endeavour, the Congress and Pakistan have helped the BJP. The former by their words and actions. The latter with export of terrorism so well exposed in movies Kashmir Files and Dhurandhar, both released during BJP rule.

 

Conclusion

What will make the BJP stop this discrimination? Hindus do not take to violence easily. At best, they write and vote.

 

The BJP is fortunate that the Congress party of today is a clone of the Muslim League and disconnected with the aspirations of a young and rising India. So the only option before Hindus is BJP. Times change!

 

Viksit Bharat is possible when Hindus progress. For that, discrimination needs to end.  

 

No wonder Mahrshi Aurobindo wrote in 1909, “When therefore it is said that India shall rise, it is the Sanatan Dharma that shall rise. When it is said that India shall be great, it is the Sanatan Dharma that shall be great. When it is said that India shall expand and extend herself, it is the Sanatan Dharma that shall expand and extend itself over the world. It is for the Dharma and by the Dharma that India exists….” India’s Rebirth
